D.M. Care Limited fined £35,000 plus costs

D.M. Care Limited has received the highest fine ever in Lancashire for breaches of fire safety regulations.

Lancashire Fire & Rescue Service have successfully prosecuted D.M. Care the owner of the Ambassador Care Home in Blackpool, for seven breaches of the Regulatory Reform (Fire Safety) Order 2005.

Reacting to the decision, Paul Ratcliffe, Protection Support Manager for Lancashire Fire and Rescue Service, said: “The sentencing of D.M. Care is the culmination of a fire safety inspection in the aftermath of a fire which disclosed significant breaches of fire safety regulations that the prosecuting Magistrate said could so easily have resulted in the loss of life.”

“The substantial total of fines with costs of £40,375 is the highest amount we have seen imposed in cases such as this in Lancashire and must surely stand as a powerful deterrent for anyone who might suppose that ensuring fire safety in premises they are responsible for is an option and not an obligation in law.”

The case was heard at Fleetwood Magistrates Court using a comprehensive evidence file prepared by Fire Safety Enforcement staff from Western Area. The defendant pleaded guilty and was fined the maximum of £5,000 per offence and ordered to pay prosecution costs of £5,375, a total of £40,375.

The prosecution was the culmination of a fire safety inspection carried out in the aftermath of a fire which identified serious breaches of fire safety regulations.

The breaches included the failure to provide a suitable fire risk assessment, failure to establish a suitable fire evacuation strategy, failure to provide adequate staff training, blocked exit routes including the placing of a ‘Santa’s Grotto’ (pictured above) on the main exit route and the failure to provide adequate fire detection.
